ONTARIO'S INDUSTRIAL EXEMPTION TO BE REPEALED

SNP has joined the campaign to help raise awareness of the upcoming repeal of Section 12(3)(a) of the Professional Engineers Act of Ontario that will impact the industrial and manufacturing sectors in Ontario. Section 12(3)(a), commonly known as the industrial exemption, allowed non-licensed individuals to practice professional engineering in relation to machinery and equipment used in the production of products in the facilities of the manufacturing entity. For work of a structural nature, licensure has always been required. The repeal, due for proclamation by the end of October 2012, will affect manufacturers by requiring either their employees and managers to become licensed (provided they meet the requirements) or have the work in question done or overseen by a PEO license holder who takes responsibility for it.

SNP's work for industrial and manufacturing clients in process and equipment design and installations in Ontario will already be compliant due to the involvement of our licensed staff. Many of our clients are quite cognizant of the benefits of engaging licensed professionals in all manner of the work in their manufacturing facilities and are well prepared for the upcoming changes. For others, to avoid complications going forward, it would be wise to contact SNP or other PEO, C of A certificate, firms practicing manufacturing engineering for further information. Also, the PEO task force (REITF) tracking the repeal, has established a website to provide more details, www.engineeringinontario.ca.

This change to the laws of Ontario will help to harmonize the requirement for engineering licensure throughout Canada (the exception existed only in Ontario). In the US, many states (including Michigan) continue to maintain an industrial exemption despite similar repeal movements. However, as in Ontario, the sophisticated manufacturing entities in the US, including many of our clients, do appreciate the benefits of engaging firms compliant in licensed manufacturing engineering practice.
